Incontestability clause

« Back to Glossary Index

Clause whereby, after a reasonable period of time has elapsed, the insurer waives the right to challenge the validity of the policy, even if there are inaccurate statements, material omissions, and, in some contracts, even fraudulent statements. Its purpose is to make life insurance policies considered absolutely secure, minimizing the possibility that the insurance company may delay payment of the insured capital.
